1. ACCEPTANCE OF TERMS

By accessing and using the FPS Airsport website (“Site”), you accept and agree to be bound by the terms and provision of this agreement. In addition, when using this Site’s particular services, you shall be subject to any posted guidelines or rules applicable to such services.

2. AGE RESTRICTION & ELIGIBILITY

CRITICAL PROTOCOL: Airsoft replicas are regulated items. By accessing this Site and purchasing products, you certify that:

  • You are at least 18 years of age.

  • You are legally permitted to purchase and own airsoft replicas in your jurisdiction.

  • You are not purchasing items on behalf of a minor without parental consent and supervision.

We reserve the right to request proof of age (ID verification) before processing any order containing airsoft replicas.

3. USE OF PRODUCTS & LIABILITY

FPS Airsport is run by hobbyists for hobbyists. However, safety is paramount.

  • Safety Gear: You acknowledge that airsoft involves the risk of injury. Appropriate safety gear (specifically ANSI-rated eye protection) must be worn at all times when operating our products.

  • Waiver of Liability: FPS Airsport shall not be held liable for any physical injury, property damage, or legal consequences resulting from the misuse, modification, or unsafe handling of products purchased from this Site.

  • Public Display: Brandishing airsoft replicas in public spaces may be illegal and dangerous. The buyer assumes full responsibility for transporting items in compliant gun bags/cases.

4. LEGAL COMPLIANCE

It is the sole responsibility of the buyer to know and comply with all local, state, and federal laws regarding the ownership, usage, and transport of airsoft replicas in their specific region. FPS Airsport will not be held responsible for items seized by customs or law enforcement due to non-compliance by the buyer.

5. TRANSPORT & DISPLAY PROTOCOLS

In accordance with Philippine laws and PNP regulations regarding airsoft replicas:

  • No Public Display: It is strictly prohibited to display or brandish airsoft replicas in public areas. Doing so may cause public panic and result in confiscation or legal action by authorities.

  • Concealed Transport: When transporting your unit to game sites or events, it must be secured inside a gun bag or hard case at all times.

  • Comelec Gun Bans: During election periods, the Philippine National Police (PNP) may include airsoft replicas in the Gun Ban. It is the buyer’s responsibility to adhere to these temporary prohibitions.

  • Liability: FPS Airsport is not liable for confiscations or legal penalties resulting from the buyer’s failure to conceal the replica during transport or open display in non-designated areas.

6. ORDER ACCURACY & PRICING

While we strive for precision:

  • Prices and availability are subject to change without notice.

  • We reserve the right to correct any errors in pricing or descriptions and to cancel or refuse any order placed at an incorrect price.

7. SHIPPING & LOGISTICS

Our “Automated Logistics” system pushes orders to couriers immediately.

  • Risk of Loss: All items purchased from FPS Airsport are made pursuant to a shipment contract. The risk of loss and title for such items pass to you upon our delivery to the carrier.

  • Tracking: It is the buyer’s responsibility to monitor the tracking number provided.

8. RETURNS & WARRANTY

  • Tampering: Opening the gearbox, removing the orange tip, or attempting internal modifications immediately voids the manufacturer and store warranty.

  • Defects: Factory defects must be reported within [Insert Days, e.g., 7 Days] of receipt.

  • Restocking Fee: Non-defective returns may be subject to a [Insert %, e.g., 15%] restocking fee.

9. INTELLECTUAL PROPERTY

The tactical branding, logos, and original content on this Site are the property of FPS Airsport and protected by copyright laws.

10. GOVERNING LAW

These Terms shall be governed by and construed in accordance with the laws of the Philippines, without regard to its conflict of law provisions.
